1) Who we are and how these terms work

These Terms of Service ("Terms") govern your use of ArtteriorAI.com and related websites, apps, and APIs (collectively, the "Service"). "We," "us," and "our" refer to the provider identified on your invoice or billing page. By creating an account or using any part of the Service, you agree to these Terms.

If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization and "you" includes that organization.

2) Accounts, eligibility, and minors

You must be at least 16 to use the Service. If you are 16–18 (or the age of majority in your country, if higher), a parent/guardian must review and accept these Terms and supervise your use. You are responsible for all activity under your account and for keeping your login secure.

3) What the Service does (and does not do)

The Service generates design suggestions, images, and related outputs from prompts and inputs you supply. AI outputs are non-deterministic and may include inaccuracies or artifacts. We do not provide architectural, engineering, or building-code advice, and our outputs are not a substitute for licensed professional services. Always verify dimensions, materials, safety, and compliance before use.

4) Your content and your rights

• Your uploads. You retain ownership of photos, floor plans, prompts, and other materials you submit ("User Content"), subject to third-party rights that may exist in such content. You are responsible for having all necessary permissions (e.g., property owners, photographers, or any identifiable individuals) and for removing metadata you don't wish to share.
• License to operate the Service. To run, display, transform, and deliver results back to you, you grant us a worldwide, non-exclusive, royalty-free license to host, process, adapt, and transmit your User Content and the resulting outputs solely to provide and maintain the Service, detect/stop abuse, and comply with law.
• Model improvement (your choice). You can opt-in to allow your prompts, uploads, and outputs to be used to improve models and features. If you don't opt in, your data will not be used for training beyond operational necessity.
• Public galleries. If you choose to publish outputs to a public gallery or make them shareable, you grant other viewers a limited license to view and share those specific items as enabled by the Service. You can unpublish at any time (caches/links may persist).

5) Output rights

Subject to these Terms and any third-party rights in your inputs (e.g., logos, portraits, brand assets), we assign to you the rights we have in the AI outputs you generate for personal or commercial use. You are solely responsible for checking that your use of the outputs does not infringe others' rights, applicable design standards, or laws.

6) Acceptable use

You agree not to:

• Violate any law or third-party rights (IP, privacy, publicity, contractual).
• Upload or generate content that is unlawful, defamatory, hateful, exploitative, or that depicts minors.
• Impersonate a person or entity, or generate look-alike content without clear, provable consent.
• Attempt to reverse-engineer, scrape at scale, or interfere with platform security or rate limits.
• Use the Service to create deceptive documentation or misrepresentations (e.g., permits, invoices, IDs).
• Circumvent usage caps, credit systems, or plan restrictions.

We may suspend or terminate accounts that breach these rules or expose us or others to risk.

7) Plans, credits, billing, and renewals

We offer tiered access (e.g., Free, Pro, Premium, Business, Companies) with different generation limits, features, and priority. Prices and inclusions are shown at checkout and may change for future terms.

• Subscription term. Plans renew automatically at the end of each billing cycle unless canceled in your Billing page before renewal.
• Credits. If your plan uses credits, unused credits may expire at the end of the cycle unless your plan states otherwise.
• Taxes & fees. Prices are exclusive of applicable taxes; you're responsible for any taxes or duties.
• Refunds. Because compute resources are provisioned immediately on generation, fees are non-refundable except where required by law or where we explicitly state otherwise.
• Trial & abuse. Two free trial per person/organization unless we say differently. We may block accounts created to evade plan limits.

8) Service changes and availability

We may modify or discontinue features, impose or change limits, or update models and interfaces. We aim for high availability but do not guarantee uninterrupted operation. We may suspend the Service for maintenance, security, legal, or technical reasons.

9) Intellectual property and feedback

The Service (site, software, models, and UI) is protected by intellectual-property laws. You may not copy or create derivative works of our code or models except as allowed by law. If you send us feedback, you give us a free, perpetual right to use it without restriction.

10) Third-party materials

Links, plugins, or integrated services are provided for convenience. Their terms and privacy practices govern your use of them. We're not responsible for third-party content or services.

11) Takedown requests and reporting

We respect intellectual property and privacy rights. If you believe content on the Service infringes your rights or violates law, contact us at [legal@artterior.com] with details (links, proof of ownership, and your contact info). We may remove or restrict access while we assess the claim.

12) Disclaimers

The Service and all outputs are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. You are responsible for verifying outputs before relying on them.

13) Limitation of liability

To the extent permitted by law, we won't be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption. Our total liability for claims arising out of or related to the Service will not exceed the amount you paid to us in the 12 months before the claim or USD 500, whichever is greater.

14) Indemnity

You will defend and indemnify us and our personnel from claims, damages, and costs (including reasonable legal fees) arising from: (a) your use of the Service, (b) your User Content, or (c) your breach of these Terms or violation of law.

15) Suspension and termination

You may stop using the Service at any time and can cancel future renewals in Billing. We may suspend or terminate your access immediately if you breach these Terms, create risk, or as required by law. Sections that by nature should survive (ownership, licenses, payment obligations, disclaimers, limitations, indemnity, governing law) will survive termination.

16) Governing law and venue

These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-laws rules. Courts located in Riyadh will have exclusive jurisdiction and venue over disputes, and both parties consent to personal jurisdiction there. (If your company prefers arbitration, we can replace this with ICC or SCCA arbitration language.)

17) Changes to these Terms

We may update these Terms. We'll post the new version with a new effective date. Material changes will be notified via the Service or email. Changes apply going forward; continuing to use the Service after changes means you accept them.
